Staff Clause of FET Amendment Act Commences

Sections of the Further Education and Training Colleges Amendment Act (2012) which relate to staff will commence on 1 April 2015.

The act which removes references to provincial authority also regulates the conduct of members of the council and staff of a public further education and training (FET) college as well as to provide for appointment of staff.

This act was necessary due to the transfer of the administration and functions of FET colleges to the Minister of Higher Education and Training by proclamation in 2009.

The sections to be enacted this April deal with the conflict of interest of staff members in conducting personal or financial business beyond their employment relationships with FET institutions.

The applicable sections are section 12 as it relates to staff other than management staff and sections 13, 28(3) and 32 (b).

The commencement date of the act was 11 May 2012 except for sections 11 to 14, 28(3) and 32b.

Sections 14, 11 and 12 as applicable to management staff commenced on 1 April 2013.

The latest commencement of sections of the act was announced in notice 209 in Gazette 37470 on 26 March 2014.
