DEA Seeks Comment on Mining Financial Provision Regulations

Comment is sought on proposed regulations pertaining to the financial provision for prospecting, exploration, mining or production operations.

The environmental affairs department published the draft regulations in Government Gazette 41236.

They were drawn up in terms of the National Environmental Management Act.

The draft regulations focus on:

•    Financial provision;
•    Transitional arrangements; and
•    Offences.

The draft regulations are designed to regulate how financial provision for costs for rehabilitation of the environment arising from prospecting, exploration, mining or production operations is determined.

Mining right or permit holders are expected to make provision for sufficient funds to undertake rehabilitation and remediation of environmental impacts flowing from mining activities.

Comment is invited within 30 days of the date of publication.
