DHA Now Responsible for Certain Customary Marriages Act Provisions

The administration of certain provisions of the Recognition of Customary Marriages Act has been transferred from the justice and correctional services minister to the home affairs minister.

The transfer of functions was announced in a proclamation published in Government Gazette 41915.

It was facilitated in terms of section 97 of the constitution.

The home affairs minister is now responsible for Section 2 dealing with the recognition of customary marriages; section 3 dealing with the requirements for validity of customary marriages; section 4 dealing with the registration of customary marriages; section 5 dealing with the determination of age of minors; and section 11 dealing with the making of regulations.

The home affairs minister now has the power to make regulations in terms of the act.

The transfer of functions took effect on the date of publication.
