Department of Justice and Constitutional Development

Draft rules for the national forum on the legal profession have been published for comment.

The justice and constitutional development department published the proposed rules in Government Gazette 41419.

The draft rules have been drawn up in terms of sections 95(1), 95(3) and 109(2)(a) of the Legal Practice Act.

Once finalised, the rules will apply to all legal practitioners (attorneys and advocates) as well as all candidate legal practitioners and juristic entities as soon as the act comes into effect.

Included in the rules are fees and charges, the council, provincial councils, professional practice, rendering of legal services, disciplinary rules and legal practice fidelity fund.

Written comment on the rules is invited within 30 days of the date of publication.

Meanwhile, the department has designated professional land surveyors, geomatics professionals and geomatics technologists as Commissioners of Oaths in terms of the Justices of the Peace and Commissioners of Oaths Act.

In a statement, the department has announced the names of a new Sheriffs’ Board.

The new board commences its duties on 1 March 2018 and will serve a three-year term.
