Regulations Relating to Sheriffs Act Amended

Regulations relating to the Sheriffs Act have been amended.

The justice and constitutional development department published the amendments in Government Gazette 42074.

Regulation 2bis is amended by a new subparagraph (i) of paragraph (d) referring to an appropriate post grade 12 qualification as determined by the board in consultation with the minister.

A new regulation 2F is also inserted focused on appointment of acting sheriffs.

The minister is empowered to appoint an acting sheriff.

Written appointments need to state the period for which the acting sheriff is appointed and the conditions of the acting appointment.

The regulations also stipulate that all court processes and other documents in the possession of the sheriff shall be taken into possession by the director-general and delivered to the acting sheriff.

The amendments also indicate that an acting sheriff is entitled to the same fees and remuneration as those of the sheriff in whose place he or she is acting.

Meanwhile, in Gazette 42068, the department published the Promotion of Access to Information Act Description for the human settlements department.

The description lists the category of records automatically available for copying and free of charge.
