State Capture Inquiry Regulations Published

State capture inquiry regulations have been drawn up.

The justice and constitutional development department published the Judicial Commission of Inquiry Regulations in Government Gazette 41436.

The Inquiry’s Terms of Reference were published last month.

The Inquiry is tasked with investigating allegations of state capture, corruption and fraud in the public sector including organs of state.

Deputy chief justice Raymond Zondo has been appointed as the Inquiry’s chairperson.

The regulations govern how the Commission is to work and facilitate the gathering of evidence including the power to search and seize and subpoena witnesses.

They also provide the legal framework for the chairperson to set up the Commission and appoint a secretary, evidence leaders and other staff members.

In a statement, the justice and correctional services minister, Adv Michael Masutha, indicated that an inter-departmental technical committee led by the department and the Office of the Chief Justice has been put in place to provide the necessary support to the Deputy Chief Justice in setting-up the Commission.
