NMW Online Exemptions System on Track

The national minimum wage (NMW) online exemptions system will go live in the last week of April 2018.

In a statement, the labour department added that the system, once online, will “focus on verifying accuracy of information, adjudicate on affordability and audit financial statements.”

A copy of the notice granting exemption must be displayed at the employer’s workplace.

The department also reiterated that exemption regulations would soon be published for comment.

Meanwhile, the department has provided an update on the labour amendment bills currently before the portfolio committee on labour with particular focus on the NMW bill.

The bill was tabled in parliament at the end of November 2017.

It seeks to:

•    Provide for a national minimum wage;
•    Establish the National Minimum Wage Commission;
•    Provide for the composition and functions of the National Minimum Wage Commission;
•    Provide for the review and annual adjustment of the national minimum wage;
•    Provide for exemption from paying the national minimum wage;
•    Provide for transitional provisions in respect of farm workers and domestic workers; and
•    Provide for matters connected therein.

The statement acknowledges that the implementation date of 1 May 2018 “may not be practical given the high volumes of public submissions both written and oral.”
