Communal Property Associations Amendment Bill Published for Comment

The Draft Communal Property Associations Amendment Bill has been published in Government Gazette 39960 for comment.

Cabinet recently approved the draft bill to be published for comment.

According to the cabinet statement, the proposed legislation will enable communities to acquire, hold and manage properties by means of administration entities supported by government.

The proposed legislation seeks to, inter alia, extend the application of the act to labour tenants who acquired land, set up a Communal Property Associations Office and the appointment of a Registrar of Communal Property Associations, provide improved protection of the rights of communities in respect of movable and immovable property administered by an association and provide for name changes of associations.

The draft bill was first gazetted on 22 April but no detail on the comment period was provided.

According to the latest notice, written comment is invited within 30 days of the date of publication of the notice.
