PC Public Enterprises Adopts Eskom Inquiry Report

The portfolio committee on public enterprises recently adopted its Eskom Inquiry Report.

The committee conducted an oversight Inquiry into allegations of governance failures and state capture at Eskom.

According to a statement, the committee holds the view that the process undertaken was an inquisitorial Inquiry and not a judicial hearing.
The committee also recommended that “law enforcement agencies make further investigations into the findings and observations made during the inquiry”.

The report will be handed over to the Zondo Commission for further investigation.

In the report, the committee recommended that adequate steps be taken by government to strengthen the legislative and policy framework applicable to Eskom.

The committee also called on the Speaker of the National Assembly (NA) with the assistance of parliament’s Legal Services Unit, to, within 60 days of the adoption of the report by the NA, refer any individuals who “may have misled the Committee during their evidence to the relevant authorities for further investigation”.

The committee also wants government to request national treasury to review and strengthen regulations on procurement pertaining to state-owned companies.

A review of the legislative and regulatory framework governing state-owned companies was also recommended.

The committee also calls for the Shareholder Management Bill to be tabled in parliament.
